An Overview of The Subdivision Approval process

Land use appropriate?

Municipalities require an appropriate land use before subdivision can be applied for.

If the new size or use of the land is different than what is allowed under a certain type, then a re-zoning is required and is subject to approval of the municipality (~3-6 months – varies per municipality).

Submit application for initial review

A tentative plan is submitted to the municipality. This shows the general scheme of the subdivision and will be circulated around the various municipal departments for review and feedback (~12 weeks – varies per municipality).

Conditional approval

Any comments are combined into a conditional approval – conditions will usually need to be satisfied within one year (12 months) in order for the subdivision to be approved.

Extensions may be granted in certain cases.

Satisfy conditions and prepare documentation

All conditions must be satisfied and any fees and taxes are paid.

This is also when we complete the legal survey and prepare the documentation for submission to Land Titles.

Submit plan for endorsement by municipality

At this step, a complete package is submitted to the municipality for endorsement. The municipality will review the conditions and issue a consent package with a Subdivision Authority Approval letter (SAA). (~12 weeks – varies per municipality)

Other consents may be required, depending on the property.

Submit to Land Titles for registration

The consent package and documentation are registered with Land Titles and new titles are officially issued (~12 weeks – varies based on Land Titles office capacity).
